Agreement
These Terms of Service apply to your use of the NeuroHome Shop and to purchases made through it. By using the store or placing an order, you agree to these terms and the policies incorporated by reference. The store is operated by NSH Operations, LLC d/b/a NeuroHome.
Who may purchase
You must be at least 18 years old and legally able to enter into a contract. By placing an order, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.
Products, programs, and pricing
We aim to describe products, programs, prices, and availability accurately. If a listing contains a material pricing or description error, we may cancel the affected order and issue a full refund.
Prices are stated in U.S. dollars. Applicable taxes, shipping charges, and other amounts will be shown at checkout where required.
Order acceptance
An order confirmation acknowledges receipt of an order. We may decline or cancel an order before fulfillment where payment cannot be verified, inventory is unavailable, shipment is prohibited, a program eligibility condition is not met, or another lawful reason prevents fulfillment. If we cancel an order after payment, we will provide the applicable refund.
Store information is not individualized advice
Product descriptions, store content, and general educational information are not a substitute for individualized medical advice, diagnosis, or treatment. Buying a retail product from the store does not by itself create a professional relationship.
A professional relationship, where applicable, begins only through the separate enrollment, consent, and professional-service processes required for the applicable program.
Device status, labeling, and safe use
Use each device only in accordance with the labeling, manufacturer instructions, product-specific safety information, and any lawful instructions provided within an applicable NeuroHome program.
The regulatory status of a device depends on the exact model, labeling, and intended use. NeuroHome will not represent a device as FDA cleared, FDA approved, or authorized for a particular medical indication unless that statement is accurate for the exact product and use being described.
Keep devices out of unsupervised children’s access. Where the manufacturer or product safety notice identifies age limits, eye precautions, photosensitivity precautions, contraindications, or medication-related warnings, those instructions control.
Programs
Programs offered for purchase through the store are subject to the program terms and any program-specific agreements provided at or before enrollment. If those documents conflict with these terms, the more specific program document controls for that program, subject to applicable law and any rights clearly promised at checkout.
Accounts and security
If you create a store account, you are responsible for keeping your credentials secure and for activity conducted through your account. Contact shop@neurohome.app if you believe your account has been accessed without authorization.
Intellectual property
Store content, including text, graphics, photographs, logos, trademarks, and design elements, is owned by NeuroHome, its affiliates, or its licensors and may not be copied, distributed, or reused except as permitted by law or with permission.
Third-party services and links
The store may use or link to third-party services, including Shopify, payment services, shipping services, scheduling tools, and other providers. Their services may be subject to separate terms and privacy practices. A link does not change the legal or privacy obligations that apply to information submitted to the third-party service.
Disclaimer of warranties
Except for express written warranties provided by NeuroHome or a manufacturer, products and store services are provided subject to the warranties and rights required by applicable law. Nothing in these terms excludes an express manufacturer warranty or a consumer warranty or remedy that cannot lawfully be disclaimed.
Limitation of liability
To the maximum extent permitted by law, NeuroHome is not liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the store or an order.
For claims that may lawfully be limited and that do not involve personal injury, gross negligence, willful misconduct, fraud, or another non-waivable right or remedy, NeuroHome’s aggregate liability relating to an affected order will not exceed the amount paid for that order.
Nothing in these terms limits liability or remedies that applicable law does not permit us to limit.
Governing law and disputes
These terms are governed by the laws of the State of Louisiana, without regard to conflict-of-laws principles, except to the extent mandatory consumer-protection law in your state applies and cannot be waived. Subject to any non-waivable right to bring a claim elsewhere, disputes relating to the store will be brought in a court of competent jurisdiction serving Calcasieu Parish, Louisiana.
Changes to these terms
We may update these terms prospectively. The terms in effect when you place an order will govern that order unless a change is required by law or you later agree to a different term where agreement is required.
